Terms of Service

1. About OwnersOnly

OwnersOnly is a private property marketplace operating in South Africa. We connect property owners directly with potential buyers — no estate agents involved. OwnersOnly is a platform only and does not participate in any property transaction.

2. User Accounts

Users may create either a buyer account (free) or an owner account (for listing properties). By creating an account you confirm that:

• You are at least 18 years of age
• The information you provide is accurate and truthful
• You will not use the platform for unlawful purposes
• Owner accounts: You are the registered owner of any property you list and are not an estate agent

3. Property Listings

Owners may list properties for a fee of R499 per listing, active for 90 days. By listing a property you declare that:

• You are the legal owner or have authority to sell the property
• All information, photos, and documents provided are accurate
• You will disclose all known defects as required by the Consumer Protection Act
• Compliance certificates declared are genuine and current

OwnersOnly reserves the right to remove or flag any listing that appears fraudulent, misleading, or in violation of these terms.

4. Payments

Listing payments are processed securely via PayFast. All payments are in South African Rand (ZAR). Listing fees are non-refundable once the listing is activated. OwnersOnly does not handle any payments related to property transactions between buyers and sellers.

5. Seller Verification

Owners may optionally verify their identity by uploading an ID document or driver's licence. Verified sellers receive a "Verified Owner" badge. Verification is conducted by manual admin review and does not guarantee the legitimacy of any property transaction.

6. No Agency Representation

OwnersOnly is not an estate agency, property broker, or financial intermediary. We do not:

• Provide property valuations or advice
• Participate in price negotiations
• Handle transfer or conveyancing
• Guarantee the condition or legality of any property

Buyers are strongly advised to conduct independent due diligence, obtain property inspections, and use a registered conveyancer for all transfers.

7. Limitation of Liability

OwnersOnly provides the platform "as is" and makes no warranties regarding the accuracy of listings, the identity of users, or the outcome of any property transaction. OwnersOnly shall not be liable for any loss, damage, or dispute arising from the use of the platform or any transaction between users.

8. Privacy

Your use of OwnersOnly is also governed by our Privacy Policy. By using the platform you consent to the collection and use of your information as described therein.

9. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.

10. Changes to Terms

OwnersOnly may update these terms from time to time. Continued use of the platform after changes constitutes acceptance of the updated terms.
